Introduction

http://demo.tixrus.us is an on-line service on the world wide web of the internet, consisting of ticketing services. Demo Tix•R•Us is an Oregon LLC with its principal place of business in the state of Oregon. The content is provided by Demo Tix•R•Us, LLC and by third parties. Demo Tix•R•Us is referred to as "we" or "our" or "us" in these rules. Whenever we refer to "you" or "your", we mean every person or entity who uses or provides content to the site.

Agreement with Rules

This section of the site sets forth the terms and conditions ("rules") that apply to your use of a site. By using or visiting the site, you expressly agree to follow these rules and all applicable laws and regulations governing the site. If you violate these rules or applicable laws and regulations, we may terminate your use of the site, bar you from future use of the site, cancel your order and/or take appropriate legal action against you. By using the site, the privacy statement is incorporated by this reference.

Changes in Site or Rules

We have the right to change or discontinue any aspect or feature of the site, including but not limited to, content, hours of availability, and equipment needed for access or use, at any time. We have the right to change or modify these rules, including, but no limited to adding fees and charges for use at any time. Such changes, modifications, additions or deletions shall be effective immediately upon posting on this site or by electronic or conventional mail, or by any other means by which you obtain notice. Any use of the site by you subsequent to such notice is acceptance by you of such changes, modification or additions. Please check this Terms and Conditions page for such changes.

Your Conduct

Basic Rules

You may not use the site to transmit any material which:
  1. violates or infringes in any way upon the rights of others;
  2. is unlawful, threatening, abusive, defamatory, invasive of privacy or publicity rights, vulgar, obscene, profane or otherwise objectionable;
  3. encourages conduct that would constitute a criminal offense, give rise to civil liability or otherwise violate any law;
  4. contains advertising or any solicitation with respect to products or services, unless we have expressly approved such material in advance of its transmission.
Any conduct by you that we believe restricts or inhibits any other user from using or enjoying a site is expressly prohibited. You may not use any robot, spider, other automatic device, or manual process to monitor or copy web pages or their content or for any other unauthorized purpose. You may not use any device, software or routine to interfere or attempt to interfere with the proper working of the Site. You may not take any action that places a disproportionately large load on the infrastructure of the Site. You may not copy, reproduce, alter, modify, create derivative works, or publicly display any content (except for your own personal, non-commercial use) from the Site without expressed written permission.

Misuse of Intellectual Property

The Site displays copyrighted material belonging to both Demo Tix•R•Us and the organizations we represent, trademarks and other proprietary information, including, but not limited to, text, software, photos, video, graphics, music, and sound, all of which belong to their owners. In addition, the content of each Site is copyrighted as a collective product. We own the copyright in both the original content and in the arrangement, and enhancement of all the content. You may not in any way exploit, any of the content, in whole or in part. Subscriber may only download copyrighted material for your personal use. No copying, redistribution, retransmission, publication or commercial exploitation of downloaded material is permitted without our express written permission and that of any other copyright owner. You do not have any ownership rights by downloading copyrighted material. In addition, you may not make available on a Site any material protected by copyright, trademark, or other proprietary right, without the express written permission of the owner of the copyright, trademark, or other proprietary right, and the burden of determining that any material is not protected by copyright rests with you. Subscriber will be solely liable for any damage resulting from any infringement of copyrights, proprietary rights. By submitting material for use on a Site, you are either granting, or warranting that the owner of that material has expressly granted, us the royalty-free, non-exclusive use of the all or any part of the material worldwide in any way for so long as any copyright may exist in such material, including the right to edit, copy, publish and distribute the material.

YOU ARE RESPONSIBLE FOR PROTECTING YOUR PASSWORD IF YOU USE ONE NEITHER WE NOR OUR AFFILIATES, NOR ANY OF OUR OR THEIR EMPLOYEES, OWNERS, AGENTS, THIRD PARTY CONTENT PROVIDERS OR LICENSORS, WARRANT THAT SERVICE ON ANY SITE WILL BE UNINTERRUPTED OR ERROR FREE OR FREE FROM UNAUTHORIZED USE OR THEFT OF INFORMATION PLACED ON A SITE BY YOU; NOR DO WE OR THEY MAKE ANY WARRANTY AS TO THE RESULTS THAT MAY BE OBTAINED FROM USE OF A SITE, OR AS TO THE ACCURACY, RELIABILITY OR CONTENT OF ANY INFORMATION, SERVICE, OR MERCHANDISE PROVIDED THROUGH A SITE. 

We Make No Warranties Of Service

WE PROVIDE EACH SITE ON AN "AS IS" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, WARRANTIES OF TITLE OR IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE, OTHER THAN THOSE WARRANTIES WHICH ARE IMPLIED BY AND INCAPABLE OF EXCLUSION, RESTRICTION OR MODIFICATION UNDER THE LAWS APPLICABLE TO THIS AGREEMENT.

We Disclaim Liability

WE DISCLAIM LIABILITY FOR ANY DAMAGES OR INJURY CAUSED BY ANY FAILURE OF PERFORMANCE, ERROR, OMISSION, INTERRUPTION, DELETION, DEFECT, DELAY IN OPERATION OR TRANSMISSION, COMPUTER VIRUS, COMMUNICATION LINE FAILURE, THEFT OR DESTRUCTION OR UNAUTHORIZED ACCESS TO, ALTERATION OF, OR USE OF INFORMATION IN ANY FORM, WHETHER FOR BREACH OF CONTRACT, TORTIOUS BEHAVIOR, NEGLIGENCE, OR UNDER ANY OTHER CAUSE OF ACTION. YOU ACKNOWLEDGE THAT WE ARE NOT LIABLE FOR THE DEFAMATORY, OFFENSIVE OR ILLEGAL CONDUCT OF OTHER SUBSCRIBERS OR THIRD-PARTIES. ANY RISK OF SUCH INJURY IS ENTIRELY YOURS. 

You Waive Damages

YOU ARE AGREEING THAT FOR ALL CONTENT ON EACH SITE, NEITHER WE NOR THOSE INVOLVED IN CREATING, PRODUCING OR DISTRIBUTING MATERIAL ON A SITE BE LIABLE FOR ANY DAMAGES, INCLUDING, WITHOUT LIMITATION, DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES ARISING OUT OF THE USE OF OR INABILITY TO USE A SITE OR FOR ANY ERRORS, INACCURACIES, OMISSIONS, OR OTHER DEFECTS IN, OR UNTIMELINESS OR UNAUTHENTICITY OF, THE INFORMATION CONTAINED WITHIN A SITE, OR FOR ANY THIRD-PARTY CLAIMS OR LOSSES OF ANY NATURE, INCLUDING, BUT NOT LIMITED TO, LOST PROFITS, PUNITIVE OR CONSEQUENTIAL DAMAGES.

Indemnification

You are agreeing to defend, indemnify and hold us and our directors, officers, owners, employees, agents, and assigns from and against all claims and expenses, including attorneys' fees, arising out of your use of the Site.

Equipment for Subscriber's Use

You are responsible for obtaining and maintaining all telephones, computer hardware, and other equipment needed for access to and use of each Site and for all charges for equipment or access.

Third-Party Site Content

Some of the content on the Site is supplied by third parties. Neither we nor any third-party provider of information guarantees the accuracy, completeness, or usefulness of any content, nor its merchantability or fitness for any particular purpose.

Ticket Purchase Policies

If your transaction involves the purchase of tickets, our ticket purchase policies are as follows:

We May Not Set Price and Availability

When we sell tickets provided by our clients, we may not set the ticket prices or determine seating locations. In addition, tickets are usually sold through several distribution points, including through our Site, phone centers, ticket outlets and box offices--therefore, tickets for popular events may sell out quickly. Due to the technical limitations of some venues and distribution modes or the policies of some event promoters, we may not control the entire inventory or its availability.

Refunds Are Available for Cancelled Events

Tickets purchased on a Site are subject to a per ticket convenience charge and a per order handling charge. If an event is cancelled or postponed by the promoter, participants or venue we will make every effort to ensure you receive a prompt refund of the ticket price and any associated refundable convenience or handling charges. The per order handling charge may not be refundable. If an event is cancelled, please  contact us for information on receiving a refund. If the event was moved or rescheduled, the venue or promoter may set refund limitations. Please contact us for exact instructions. Have available your order number information so we can process your refund as quickly as possible. Tickets purchased from outlets other than the Site must be returned through the outlet from which you purchased the tickets.

Refunds and Exchanges

Except for cancellation and a handful of other extremely unusual circumstances we are not allowed to issue refunds after a ticket has been purchased, even if the ticket is lost or destroyed. Our buyer protection policy guarantees seating without a ticket as long as the customer is registered. Please carefully review your event and seat selection before purchasing tickets. Under certain circumstances exchanges may be permitted if seating is available. The following conditions must apply: In the case where the new seats are lower priced than the original ones, no refund will be issued. An exchange fee may also be charged.

Ticket Delivery

The event producer has three options:
  1. Physical Delivery through the carrier of their choice
  2. Will-calls, i.e. you pick up your tickets at the event at the box office
  3. Self-print, i.e. you print your own tickets

Delivery to postal address via carrier

Physical tickets delivered by a carrier are not required. Any ticket purchased online through our system can be delivered electronically via the internet on demand as a self printing ticket, even if the client chooses to deliver hard copy tickets in addition. Our clients are required to accept self-printing tickets even when it is not their preferred ticket format. If the event producer has chosen to deliver your tickets through the mail or other carrier, please allow up to 30 days for delivery of your tickets. If the tickets are advertised as being delivered by mail, any tickets ordered after 5 days before the event will be held as will-calls regardless. If you have not received your tickets within 48 hours of the event, please contact the agent who is in charge of ticket fulfillment--this may be Demo Tix•R•Us or the event promoter. Occasionally, we receive incorrect billing or credit card account information for a ticket order that can delay processing and delivery. If your payment has been received and your tickets have merely been lost or not delivered you may claim your seats at the event by presenting your receipt with your order number and picture id.

Will-Call

Tickets delivered through Will-Call are typically available one hour prior to the event start time at the venue or at a location chosen by the event promoter. You may be asked to present your order number or receipt, the credit card used to purchase tickets and/or picture identification. Will call tickets may be paper tickets, either the self printing ones provided by Demo Tix•R•Us or some other ticket format provided by the presenter, or there may not be a document involved at all -- they may just validate your name against a list.

Self-Print

Self print tickets are designed to validate electronically very quickly and to optimize the logistics of filling the house. If you self-print your tickets, please also be prepared with receipt containing order number and picture identification, in case of technical difficulties. If the person who purchased the tickets is not present with the ticket holder, the ticket holder should be prepared with a copy of the receipt, or know identifying data about the purchaser, such as their address or city, so that the ticket can be validated in the absence of electronic validation.

Demo Tix•R•Us does not guarantee delivery of physical tickets

We guarantee seating at events for people who purchase it through us, and who can validate their purchase. Tickets are merely pass tokens that expedite filling the house. Many of our clients use the U.S. mail for disemmination of physical tickets. Regular U.S. mail is an unguaranteed untrackable delivery system that reports a 97% success rate for first class, and our own track record indicate closer to 99% success. If even 97% of the patrons to an event have tickets the house will fill just fine. The three or less percent who fail to receive tickets can still be seated by presenting their receipt and picture ID. Checking ID and receipt is cumbersome and would probably cause congestion if the box office personnel had to do it for everyone, hence tickets. But a customer who has purchased seats cannot claim nondelivery and demand a refund, since they are still able to receive the benefits for which they paid.

We May Limit the Number of Tickets Per Customer

If a determination has been made by the promoter or producer of the event that it is necessary to discourage unfair ticket buying practices for a particular event, you may be limited to a maximum specified number of tickets when purchasing tickets for the event. This limitation is included in the information you receive while placing your order.

Entire Agreement

This agreement and our Rules for the Sites are the entire agreement with you regarding the use of the Site, and supersede earlier written or oral agreements with you on this subject. The section headings we have used are for convenience only and will not be given any legal import whatsoever. This agreement will be construed in accordance with the laws of the State of Oregon, without regard to its conflict of laws rules. Any cause of action of any nature arising out this agreement shall be brought in Benton County, in the State of Oregon.
